Public Offer Agreement

PUBLIC OFFER

Ozherelev Lev Nikolaevich, TIN 772 371 251 200 (hereinafter — the «Photographer»), under clause 2, article 437 of the Civil Code of the Russian Federation, offers to the general public to enter into a commissioned work agreement under the following conditions (this public offer). Acceptance of this offer constitutes the conclusion of a Contract (article 433 of the Civil Code). Fulfillment of this Contract’s terms is mandatory for both parties.

1. DEFINITIONS

1.1. Photograph — a visual image resulting from a photo session.

1.2. Offer Acceptance — full and unconditional agreement to the Offer as described in clause 2.4.

1.3. Contract — the commissioned work agreement between Photographer and Client.

1.4. Website — the Photographer's site at lvzhs.ru.

1.5. Application — a message from the Client with details of the selected package and shooting time.

2. SUBJECT OF THE CONTRACT

2.1. The Photographer agrees to perform a photo session, create works, and grant usage rights. The Client pays the agreed fee listed on the Website.

2.2. Details like duration, quality, additional services are in the Application.

2.3. The Photographer retains inalienable copyright and proprietary rights.

2.4. Acceptance includes messages or checkbox consent on the Website.

3. ORDER EXECUTION

3.1. The shoot occurs at the agreed time and place.

3.2. Photographer suggests locations, makeup artists, and concepts. Final choices are Client’s responsibility.

3.3. Photographer has full creative control including gear, editing, and style. Client accepts their portfolio style.

3.4. If Client chooses location/time, they ensure lighting and aesthetics.

3.5. Looks (wardrobe, makeup) must be pre-approved. Photographer is not liable for non-approved styling.

3.6. Works are delivered within the terms on the Website.

3.7. Delivery is via cloud link in JPEG format. No RAW or unedited material is shared.

3.8. Photos are stored for 30 days. Client must save them within that time.

3.9. Complaints must be submitted within 2 days; otherwise, services are deemed accepted.

4. COPYRIGHT

4.1. Photographer is the sole author.

4.2. A non-exclusive license is granted for non-commercial use including online publication.

4.3. Rights are unlimited in time and territory.

4.4. Author credit is required; no alterations allowed.

5. FEES

5.1. Fee as per Website or mutual agreement.

5.2. License is free.

5.3. Payment is due on photo delivery day.

6. IMAGE RIGHTS

6.1. Client consents to use of their and their children’s images for promotional use online, on social media, and exhibitions. Consent is unlimited in time and territory.

7. LIABILITY

7.1. Client is responsible for others present.

7.2. Photographer is not liable for Client’s appearance or mood.

7.3. Delay over 15 minutes reduces session time proportionally without discount.

8. DISPUTE RESOLUTION

8.1. Disputes should be resolved via negotiation.

8.2. If unresolved, they are subject to court in accordance with Russian law.

9. PERSONAL DATA

9.1. Client consents to processing of their name, email, and phone under Federal Law No. 152-FZ and the Privacy Policy.

9.2. Purposes: identification, service access, communication, and settlements.

9.3. Client may revoke consent via email.

10. MISCELLANEOUS

10.1. The Contract takes effect upon acceptance and is valid until obligations are met.

10.2. Communication is via messengers or email and is legally binding.

10.3. Acceptance is binding regardless of signature.
